Decisions in the Serres d’Auteuil or Samaritaine cases raised the fear that the use of heritage protection associations in the Council of State – an institution where there is no equivalent in other democratic countries – is certainly doomed to failure. Fortunately, common sense and legislation seem to triumph for a while in a much-discussed case, but we had not really been treated in The Tribune of Art (except here) to be able to investigate early enough: the construction of Beynac’s derivation, in the Périgord. In fact, in a judgment of 28 December 2018, the Conseil d’État considered that this project was not responding to a compelling reason of overriding public interest, it seems likely that in the state of the investigation serious doubts would arise as to the legality of the contested decree “and therefore decided that the decree of the prefect of the Dordogne of 29 January 2018, authorizing the works, was suspended.

Since then we have been there, we have been able to visit the site, the construction site and meet the local actors. On the other hand, we will not hear from the initiators of this project, from the department of the Dordogne, nor from the services of the prime minister. Germinal Peiro, the chairman of the department, sent us the following laconical e-mail: “We will not answer your questions”, and the communication department of Matignon never answered us.

Let’s remember what it is in two words. The village of Beynac, a historic village in the Périgord, with its medieval houses clinging to the hill along the Dordogne river (Fig. 1), was traversed by a road that was too narrow. summer, significant growth delays. The deviation project consists of passing the road within the arch of the river that runs through Beynac. Figure 2 shows better than a long speech what it is: make two new bridges over the Dordogne, the bridge of Pech and the bridge of Feyrac to build a road to the south of the village that will make it possible to avoid cross it.

This project is not new because it was proposed in the 1970s, as part of what was then called the “valley road”. But it was finally decided to road Sarlat, 8 km north, who condemned raising de facto construction of that part that had no real justification, the bulk of traffic now had by Sarlat.

“The deviation of Beynac” It was Fernand Peiro, the father of Germinal Peiro, who revived this project in a very specific context that makes it possible to better understand the ruthlessness of the latter. Fernand Peiro had indeed decided to become mayor of Beynac where he came from. Unfortunately for him, he was defeated in the 1971 elections and realized that he would never be elected. He turned his ambitions into the city of Vézac, near Beynac, and never ceased to want to create that famous deviation he hoped would lead to the transfer of economic activity in Vézac Beynac. The project was revived, leading to three consecutive public investigations. The first, in 1989, gave a favorable opinion, but the project was already rejected by the Council of State. In 1993 the report was unfavorable this time and the case ended there. But for the third time in 2000, at the request of Fernand Peiro, the department returned to the tax and the conclusions of the public inquiry were favorable again despite the opposition of the vast majority of people who participated. But the project was never carried out, the then president of the department, Bernard Cazeau, who ensured that it did not become his property. Long of the same political Fernand and Germinal Peiro (it is now a member of LREM), he was aware – and does not hesitate to know today – that this project was useless and harmful. This failure was the personal copy of the Peiro family. But revenge is a dish that is eaten cold and Germinal Peiro took over the fight from his father. The deviation from Beynac had to be done, regardless of whether this was necessary.

We have to go to the town hall of Vézac to better understand psychology in this case. It shows a ridiculous monument in honor of Fernand Peiro (ill.3), built by the municipality after the death of the mayor, where the socialist rose is mixed with many masonic symbols. His son does not hide from his membership of Freemasonry, which makes his opponents say that it is not strange to the relative ease with which he was able to obtain the necessary authorizations for the project.

The deviation of Beynac: the signs of a sick democracy

“The deviation of Beynac” For all the reasons that should have led to the definitive abandonment, the work of the past few months, which are unfortunately very advanced, even if they are now stopped, could be legally carried out. Based on a declaration of public utility dating back to … 2001, that is almost twenty years ago! According to Kléber Rossillon, owner of Château de Castelnaud not far from Beynac, one of the fiercest opponents of this deviation, the signature of the commissioner-researcher of time on the public inquiry (the third one that was therefore realized ) are proudly framed by three points, Masonic symbol. We could not verify it because we did not find this document. It is still the case that Germinal Peiro, after joining the presidency of the department on April 2, 2015, resumes the case where he stayed.

The deviation of Beynac: the signs of a sick democracy
The deviation of Beynac: the signs of a sick democracy “NON AU MASSACRE DE LA VALEE” THIS NATURE WILL SOON BECOME THE PAST. !!!

“The deviation of Beynac” But since 2001, many things have changed. On the one hand, the construction of the A89 motorway reduced the traffic that could pass through Beynac considerably. And above all, since 2015, this municipality has been working on widening the road along the Dordogne Works that, thanks to Bernard Cazeau, would be subsidized by the department. The president of the department fully understood that this extension would be a fatal blow to the deviation. The new president was also convinced and for this reason he refused to pay the granted subsidy of € 600,000. The Mayor of Beynac was called to the Department by Germinal Peiro, who told him that he was not bound by the promises of his predecessor.

But the city still did the work. And in April 2017, to disrupt this project again, Germinal Peiro asked Beynac to build a pavement for a restaurant, a sidewalk that never existed and that would have resulted in limiting the width of the passage to 4, 30 m while the narrowest width after working should be 5.13 m (thanks to the work of the municipality, the pavement is now on average 5.30 m by 30 m and 6.10 elsewhere). According to what the deputy mayor had explained to us, the president of the department had to reduce the width of the road.

The deviation of Beynac: the signs of a sick democracy
“NON AU MASSACRE DE LA VALEE”

Then there was a rather astonishing scene (see this article from the southwest): when the department decided to carry out the work itself and with construction equipment accompanied by handlers, the mayor of Beynac stood before him. the bulldozer to prevent it from moving forward. A bailiff noted the facts, but the widening of the sidewalk could not take place. The case is now brought to court. In addition, the department was responsible for re-paving the pavement, which has not been implemented since September 2017. The deputy mayor told us that the prefect had instructed the department to do this. and that it should be before February 2018. But we are still waiting.

Beynac’s work finally solved the traffic problems that could still occur and which were mainly focused on the summer period. A census was organized at the request of the City Hall last August (week 3 to 9 August) by the company Provence (PCR). The result showed that the traffic flow was fluid, complete stopping points of traffic on average not more than 21 seconds. In one week, only five stops could be counted for more than two minutes.

But Germinal Peiro does not differ: in fact, it says that two trucks can not cross. That is a very special way to describe reality. Because in France, the maximum width of a heavy weight allowed 2.55 m, 2.60 refrigerated vehicles. So let’s face the worst case: two trucks of 2.60 width that would cross the road at one place (ie say up to 30 meters) where it is possible that the width does not exceed 5 13 m (since the rest of the road, the width of 6.10 is sufficient). There are three things: this case is statistically quite rare; it can occur in many villages where the road is narrower than 5.20 m; and especially the truck drivers know in this case that they are working on one after another.

To justify its determination, Germinal Peiro claims the spokesman without ranks against the “gentlemen” and shows in particular feathered against Stephane Bern, who took the cause of the opponents: “This is an ignorant.” He repeats stupidly what his chatelain friends tell him. Bad luck, the facts belie the claims of the president of the department A study carried out by the Quota society on the population of the Dordogne has produced the following results: while 64% of the inhabitants project (which is a remarkable result in itself), 55% voted for a halt to work (against 27% for its continuation), and women, 30-44 year-olds and CSP against this project, 62, 66 and 63% respectively! In addition, 88% of the respondents were in the last public inquiry that concentrated on the construction of the bridges only (since the remainder 001 was “validated”) against this work. We still wonder about the presence of 88% of the “castellans” in the Dordogne …

It is nevertheless certain that the castles in this region are numerous and that they attract the tourists. No less than six are influenced by the construction of the derivation as some of which are very close and all others have seen.

Just walk along the site to understand how destructive the construction of the road is for the landscape and the ecosystem. In addition to concrete poured in the Dordogne to build the piles of bridges , the route had to cut hundreds of trees and the photos we took show how much road visible from everywhere,Including Beynac (ill 13). During our visit in November, the associations had just discovered that there were two greenhouses that were not there yet : the construction of a major traffic route would inevitably have a drastic change in the landscape that has remained unchanged for centuries.

As far as the biosphere is concerned, it is sufficient to recall that the whole Dordogne basin has been classified by UNESCO in the zone “biosphere reserve” (there are only 631 in the world). This requires that only sustainable development projects be implemented (a qualification that no one has yet dared to associate with the deviation). That so far we can make a project that is so clearly antinomic with such a classification, unfortunately shows once again the weak strength of the UNESCO ranking. But perhaps it should also be the result of a curious conflict of interest: who is in charge of the Dordogne Biosphere Reserve? EPIDOR, the territorial public institution of the Dordogne basin. And who is the president of EPIDOR? Germinal Peiro … Should it develop further? Yes, perhaps, with an emphasis on the good taste that is in charge of the work done or approved by Germinal Peiro. So during our visit, sick.

“The deviation of Beynac” An undercover victim of this work was a large Gallo-Roman basin uncovered during the works of the road. This affair in the case, which was extensively discussed in the press this summer , gave rise to several steps between the associations opposing the bypass and hoped to slow down or even stop the work by maintaining this structure to lay. , while Germinal Peiro continued to minimize the discovery. Was this important? The photos we have available to think about . But unfortunately we will know absolutely nothing since we rely on the immobilism of the Ministry of Culture and we are worried about the consequences of this discovery. The department wanted to destroy everything in two phases , after having remarked to a Dijon expert that these remains “occurred quite often and did not deserve to be kept”. Without being able to investigate exactly this question, we can only determine the damage. There is nothing left of the Gallo-Roman structure. It remains only to believe that Germinal Peiro …

It would be a mistake to blame the chairman of the department. When he became aware of the judgment of the Council of State, it was reminded that it was “the state services that gave permission to do this job.” “And on this point he is absolutely right.” The prime minister has seriously failed, he who was free to prevent the beginning of the work if he had the courage, he is the acting ministries of Environment and Culture who had strong doubts about the value of this project and also who personally prevent the success of this project. file arrived at the same time as the cancellation – legitimate and happy – of the construction of the Notre-Dame-des-Landes airport, if he had stopped the Beynac deviation – and also the Great Western Circumvention project in Alsace (see our He was afraid that people would say that nothing could be done about it, because this lack of courage on the part of the prime minister is serious because it also suggests that although many claims are made about “yellow vests”, only violence results and can yield. The opponents of Beynac’s distraction wanted to act in the context of legality, they did not commit any violence, that is their only crime that seems to tell Édouard Philippe.

The deviation of Beynac: the signs of a sick democracy
The deviation of Beynac: the signs of a sick democracy Demande “NON AU MASSACRE DE LA VALEE”

“The deviation of Beynac” Are we really in a democracy when work is started when all remedies have not been completed and a construction site can be declared illegal after the start of the work? Germinal Peiro did not hesitate to accelerate them when the decision of the Council of State was predictable. What will happen now if the Administrative Court of Bordeaux – the one denied by the Council of State – agrees with its opinion and finally concludes that the work must be interrupted? How can you return to the original state when tons of concrete have already been poured into the Dordogne and many hundred-year-old trees have been cut?

It is unbelievable that Germinal Peiro today complained about the decision of the Council of State. According to him, the consequences are “disastrous […] financially, because in addition to the 15 million that have already been paid, invoices come from already incurred expenses and contracts”. But who initiated the work knowing that the Council of State can still be opposed to it, if not Germinal Peiro? Who has probably lost at least 15 million euros to his department, otherwise Germinal Peiro?

The deviation of Beynac: the signs of a sick democracy
The deviation of Beynac: the signs of a sick democracy

“The deviation of Beynac” This goes further and complains that the consequences “are also disastrous for the environment, because the damage to the habitats of the protected species is being done”? But who damaged the protected species in a biosphere reserve of UNESCO, if not Germinal Peiro? He adds: “We would go into the repair and compensation phase and that is what has stopped.” We must understand here that the head of this disaster will not convert “planned repairs and compensation”, which is now nothing but the restoration should declare as clean as possible that it has destroyed?

Do not shout the victory too quickly. Contrary to what we read here and there, the judgment of the Council of State is not final and it would be enough to take a new decision before the administrative court of Bordeaux to revive works that can be continued during this time. waiting for other remedies [5]. It is when the central state fails in its mission that feudalism can be restored. That is actually what we are talking about here.
